Decreto 1120/2008 Régimen del Sector Privado y del Régimen de Afiliación Individual

DECRETO 1120/2008
PODER EJECUTIVO DE LA PROVINCIA DE SALTA
Instituto Provincial de Salud de Salta. Libertad de Contratación. Régimen del Sector Privado y del Régimen de Afiliación Individual. Modificación del dec. 3402/2007.
del 11/03/2008; Boletín Oficial: 19/03/2008.
Visto el Decreto N° 3402/07 Reglamentario de la Ley N° 7127 de creación del Instituto Provincial de Salud de Salta (I.P.S.), y,
Considerando:
Que las atribuciones y deberes constitucionales conferidas al Gobernador de la Provincia en el artículo 144 inciso 3ro. de la Constitución Provincial, le otorgan la facultad reglamentaria;
Que en uso de dichas facultades, se dictó el Decreto N° 3402/07, estableciendo la reglamentación de la ley de creación de la Obra Social Provincial;
Que a la fecha, resulta menester modificar algunas disposiciones contenidas en el mismo, a los fines de permitir la implementación y concreción de nuevos objetivos en la Obra Social, los cuales redundarán en beneficio de los afiliados y beneficiarios del Instituto Provincial de Salud de Salta (I.P.S.);
Que precisamente es voluntad de la actual gestión de gobierno modificar la reglamentación bajo análisis en lo que respecta a la cuestión operativa del I.P.S. en el ámbito de las afiliaciones individuales, en razón del dinamismo propio de dicha operatoria, lo que hace necesario no cristalizar la normativa referida, dado los continuos cambios en el sistema individual;
Que a tales efectos se entiende que las cuestiones de: condiciones de ingreso, requisitos, incorporación-duración, traspasos, cuotas mensuales, reingreso, revocación y término de incorporación, responsabilidad del I.P.S., limitaciones y exclusiones, son temas que demandan una modificación continua en el transitar de la Obra Social, en virtud de los continuos avances y contrastes del sistema de salud vigente, en pro de un mejor servicio para los afiliados, como asimismo para el correcto funcionamiento de la entidad autárquica;
Que el dinamismo mencionado se traduce en el dictado de normativa propia por parte de la Obra Social, que como ente autárquico y dentro de las atribuciones emergentes del artículo 4 de la Ley N° 7127, puede emitir a los fines de cumplir y hace cumplir eficientemente el objeto social previsto en el artículo 2° de la ley de creación;
Que asimismo se entiende necesario modificar el artículo 4.10.III.b, en cuanto excluye la posibilidad de financiar el Copago o coseguro a las personas que se encuentren incorporadas al sistema de salud a través del Régimen de Afiliación Individual o por convenios del Sector Privado;
Que es posible incorporar tales afiliados al sistema de financiación del copago, siempre que existiesen partidas financieras disponibles y de conformidad a la normativa vigente de la Obra Social, siendo obligatorio el cumplimiento de los requisitos previstos para los afiliados forzosos;
Que asimismo resulta de carácter imprescindible para acceder a la financiación del copago, la presentación de un garante que revista el carácter de empleado público provincial o municipal de planta permanente;
Por ello y en ejercicio de las facultades previstas en el artículo 144 de la Constitución Provincial y Art. 1° de la Ley N° 7483, el Gobernador de la Provincia de Salta decreta:
Artículo 1° – Modifícase el inciso 10.III.b del artículo 4 del Decreto Reglamentario N° 3402/07 con respecto a las condiciones de financiamiento del copago, el cual quedará redactado de la siguiente manera:
4.10.III.b.- Con financiación “El I.P.S. podrá financiar el copago o coseguro siempre que existiesen partidas financieras disponibles. Los afiliados y sus beneficiarios y/o adherentes podrán solicitar la financiación del copago fijado para la prestación respectiva, previo cumplimiento de la normativa vigente. Las personas que se encuentren incorporadas al Sistema de Salud a través del Régimen de Afiliación Individual o por Convenios del Sector Privado, con carácter imprescindible para acceder a la financiación del copago, deberán presentar un garante que revista el carácter de empleado público provincial o municipal de planta permanente”.
Art. 2° – Modifícanse los incisos 2 y 2.1 del artículo 6° del Decreto Reglamentario N° 3402/07, los cuales quedarán redactados de la siguiente manera:
6.2.- Régimen del Sector Individual.- “El I.P.S. mediante reglamentación interna fijará el régimen mensual y los alcances de la cobertura social a través del Régimen de Afiliación Individual que se constituye como una Unidad de Negocio sujeta a las pautas provinciales y siendo de aplicación el Régimen Legal de las Obras Sociales Nacionales ni la normativa referida a la Medicina Prepaga.
6.2.1.- Concepto.- Un afiliado individual adherente, es toda persona física que de manera voluntaria y contractual se obligue con esta Obra Social al pago por adelantado de una cuota mensual en contraprestación de los servicios que se le brindan. Este afiliado no reviste el carácter de forzoso ni de privado. El monto de la cuota será establecido por la normativa interna vigente.
Art. 3° – Deróganse los incisos 2.2, 2.3, 2.4, 2.5, 2.6, 2.7, 2.8, 2.9, 2.10 y 2.11 del artículo 6° del Decreto Reglamentario N° 3402/07 con respecto a: condiciones de ingresos, requisitos, incorporación – duración, traspasos, cuotas mensuales, reingreso, revocación y término de incorporación, responsabilidad, limitaciones y exclusiones del Régimen de Afiliaciones Individuales del I.P.S.
Art. 4° – El presente decreto será refrendado por los señores Ministro de Salud Pública y Secretario General de la Gobernación.
