Secreto medico y aborto

No es difícil encontrar en los anaqueles judiciales planteos que resultaron delicados dilemas, colisiones de deberes impuestos a una misma persona o superposiciones de derechos que el juez, en una limosa y difícil tarea, debió resolver en favor de alguna de las partes y en aras de lograr una armonización de los intereses en conflicto de la vida social de la comunidad. Quizá una muestra de esto que describo es la situación impuesta al médico, en tanto debe denunciar en forma obligatoria los delitos que lleguen a su conocimiento bajo pena de caer incurso en el delito de encubrimiento (Art. 160 del Código Procesal Penal del Neuquén y 277 inc. D del Código Penal) cuando, paralelamente, la ley lo castiga si viola el secreto profesional (Art. 156 del Código Penal).
Planteada entonces la antinomia, es decir, debiendo cumplir el médico dos obligaciones -por lo menos en apariencia- contrapuestas, nos preguntamos qué es lo que debe hacer el galeno con la mujer que provoca su propio aborto o se lo hace provocar y luego, por una complicación en este procedimiento, acude al hospital a hacerse atender (por ejemplo, a causa de una hemorragia).
Si opta por cumplir con uno de los deberes, es decir, efectúa la denuncia, puede ser castigado por el delito de violación de secreto profesional y, si omite denunciar, puede ser castigado por encubrimiento. Y esto sólo del lado del médico, pues una disyuntiva aún peor quedará para la persona que cometió el ilícito -en nuestro caso, la abortista-, pues discurrirá entre recibir asistencia médica e ir a la cárcel -de la mano del profesional-, para utilizar un lenguaje llano pero no menos alegórico.
Antes de arriesgar una respuesta propia, resulta oportuno resaltar que la Justicia, ‘atrapada en los cuernos de este dilema’, tuvo oportunidad de expedirse sobre esta situación en el famoso fallo plenario Frías Natividad, resuelto hace más de cuarenta años por la Cámara Nacional de Apelaciones en lo Criminal y Correccional de Capital Federal. Allí se resolvió, con sano criterio -según quien escribe-, que no puede incriminarse a la mujer que cometió aborto en base a la denuncia efectuada por el médico al que le tocó atender las complicaciones puerperales posteriores. Y, de soslayo leemos, que el médico no está obligado a denunciar este delito. La lógica del fallo, en ajustada síntesis, se reproduce; de aceptarse la declaración del médico para incriminar a la paciente se estaría obligando a la mujer a declarar contra sí misma. Divulgar el aborto cometido por la paciente implicaría para el médico violar el secreto profesional, lo cual es un delito. La mujer debe elegir entre ‘muerte y cárcel’ (morir fruto de las heridas generadas por el aborto o ser enjuiciada por acudir a un hospital) y, por último, el delito sólo criminaliza a las mujeres de determinada clase social (las que acuden a los hospitales públicos).
Debemos resaltar que el fallo no recibe con exultación el aborto ni pretende su despenalización, ni siquiera se expide sobre el asunto; sólo menciona que no se castigará a la mujer que lo cometa si la notitia criminis llega por boca del médico que la atendió en la complicación posterior. La idea que subyace es que, ante todo, la principal función del médico es restablecer la salud de su paciente y resaltar que, por haber delinquido, una persona no pierde el humano derecho de recibir asistencia médica.
Lo cierto es que este fallo, con matices y con mayor o menor grado de aceptación, se sostuvo hasta la fecha, aunque con algunas salvedades.
Empero, recientemente (en abril de este año) la sala VII de la Cámara Nacional de Apelaciones en lo Criminal y Correccional dictó un nuevo fallo -conocido como el caso Gallo. N- que abandona el criterio anterior, encargándose de rebatir todos y cada uno de los argumentos allí expuestos.
Es decir que el nuevo criterio sentado por este tribunal es que es deber del médico denunciar a quien asiste a un centro asistencial por complicaciones en un aborto y que su denuncia es válida para incriminar a quien lo cometió.
En este planteo que hoy lacónicamente reproducimos convergen problemas jurídicos, morales y filosóficos. No se trata solamente de resolver si denunciar o no hacerlo, determinar los límites del secreto profesional o simplemente elegir qué derecho u obligación debe prevalecer en el caso concreto; ello está claro. Pero, si los hacedores de este fallo hubieran tenido en cuenta los siguientes guarismos, quizá el resultado del fallo sería otro. En la Argentina, uno de cada tres abortos clandestinos debe ser hospitalizado. Las complicaciones del aborto constituyen la primera causa de internación -excluyendo el parto- de mujeres en los hospitales públicos. El aborto ocupa el primer lugar entre las causas de muerte materna. Se estima que cada año mueren en el país alrededor de 500 mujeres y otras 15.000 quedan afectadas en su estado de salud por causas relacionadas con el embarazo, parto y puerperio. Se calcula que, sobre el total de los abortos realizados en el país entre las mujeres rurales, un 73% es llevado a cabo a través de auto-abortos o mediante personas no calificadas -llámense curanderas, comadres o simplemente idóneos-. Entre las mujeres urbanas de escasos recursos, se llega a un 57% a través de los medios ya mencionados, y en cuanto a las de altos recursos, un 90% de los abortos se realiza a través de médicos o personal calificado, según lo revelan estudios recientes.
La conclusión es simple: si se obliga al médico a denunciar a su paciente, se estará disuadiendo a ésta de que se hospitalice, y si se disuade de la hospitalización la única consecuencia posible es el aumento del número de muertes por esta causa. Frente a este planteo, las nuevas perspectivas son pésimas.
Debemos dejar un camino abierto para las mujeres, la posibilidad de un recorrido diferente que envuelva orientación médica y psicológica, consejo y encauce hacia servicios de anticoncepción, planeamiento familiar y de apoyo a víctimas de violencia sexual, quebrando de esa manera el círculo vicioso que acostumbra a traerlas de vuelta al mismo lugar: un nuevo embarazo no planificado o forzado, como se mencionó en un proyecto de ley.
Es cierto, como lo afirmó Tagore, que ‘El juez está más atado por su ley que el prisionero por sus cadenas’, pero no lo es menos que ‘No está la justicia en las palabras de la ley’, como lo afirma Cicerón, sino más bien en la forma en que ésta es aplicada.
En la ciudad de Santa Fe, a los doce días del mes de agosto del año mil novecientos noventa y ocho, se reunieron en acuerdo los señores Ministros de la Corte Suprema de Justicia de la Provincia, doctores Jorge Alberto Barraguirre, Roberto Héctor Falistocco, Casiano Rafael Iribarren, Decio Carlos F. Ulla y Rodolfo Luis Vigo, con la presidencia del titular doctor Raúl José Alvarez, a fin de dictar sentencia en los autos “INSAURRALDE, Mirta -Aborto Provocado- sobre RECURSO DE INCONSTTITUCIONALIDAD” (Expte. C.S.J. nro. 1105, año 1996).
Se resolvió someter a decisión las cuestiones siguientes:
PRIMERA: ¿es admisible el recurso interpuesto?,
SEGUNDA: en su caso, ¿es procedente? y
TERCERA: en consecuencia, ¿qué resolución corresponde dictar? Asimismo se emitieron los votos en el orden que realizaron el estudio de la causa, o sea doctores Vigo, Ulla, Barraguirre, Iribarren, Falistocco y Alvarez
