Ley de Contrato de Trabajo: Reintegro de gastos y resarcimiento de daños

Este tema de los reintegros de gastos y resarcimiento de daños, es muy importante y a tener en cuenta, ya que muchos medicos que trabajan para distintas empresas, ponen sus vehiculos a disposicion de las empresas para realizar los controles, y llegado el momento es bueno tomarlo en cuenta.

Art. 76 : El empleador deberá reintegrar al trabajador los gastos suplidos por éste para el cumplimiento adecuado del trabajo , y resarcirlo de los daños sufridos en sus bienes por el hecho y en ocasión del mismo.

COMENTARIO : El reintegro de gastos y el resarcimiento de daños están relacionados con el ejercicio de la función. Se devuelve lo que se ha gastado en virtud del trabajo ( por ejemplo , la compra de una herramienta ) y se resarcen los daños sufridos por el trabajador en sus bienes por el hecho y en ocasión del trabajo . Se trata de los bienes que normalmente introduce al trabajo ( por ejemplo , el violín que el músico utiliza en la orquesta , la bicicleta con la que se traslada al trabajo ).
